ICE shooting in Austin, Texas leaves 1 person injured. What we know

Sept. 21, 2026Updated Sept. 23, 2026, 8:20 a.m. ET

An Immigration and Customs Enforcement officer shot and injured a man in North Austin on Sept. 20, officials say.

The man who was injured in the shooting was identified as Wilber Rafael Garces Perez, 28, of Venezuela, by Austin immigration lawyer Kate Lincoln-Goldfinch, who said she was hired to represent him.

The incident was followed by a swift reaction from elected officials, as the public protested the latest shooting involving federal officers in the United States this year.

Here is what we know so far about the shooting in Austin and the public's reaction.

What happened in Austin, Texas?

At a news conference in Austin on the afternoon of Sept. 20, city officials said the shooting occurred around 12:56 p.m. local time.

A man, whom city officials did not identify, was taken to a local hospital in serious but stable condition with one gunshot wound, according to previous USA TODAY reporting.

Austin Police Chief Lisa Davis said the man was shot after a "small foot pursuit" and that the department was in contact with the Department of Homeland Security and other state law enforcement agencies.

Austin Mayor Kirk Watson confirmed that local police were not involved in the operation that led to the shooting. However, Watson said he wants an independent investigation into the shooting so the city's residents know what happened and why.

Lincoln-Goldfinch on Sept. 20 said Garces Perez was in the middle of a DoorDash delivery when the incident occurred.

In a social media post on Sept. 21, Lincoln-Goldfinch said Garces Perez is being held at the South Texas ICE Processing Center in Pearsall — roughly 135 miles southwest of Austin "for interrogation and still has the bullet lodged in his body. He's received no pain medication and had to sleep on the floor."

Where is Garces Perez located?

In a social media post Sunday night, Lincoln-Goldfinch said she still has not been able to locate Garces Perez in the ICE system or speak with him.

"I have now seen photographs showing a gunshot wound behind his neck. I have seen video from the incident. I want to see the body-camera footage. I want to know exactly what happened before an ICE officer fired a weapon," Lincoln-Goldfinch said in a statement.

The BBC and Texas Tribune have reported officials saying that Garces Perez was shot in the torso/upper torso.

DHS said in a statement Sunday night that Garces Perez's "condition is stable, and he is in federal custody pending removal."

James Talarico, elected officials condemn Austin ICE shooting

Austin-area Democratic state Rep. James Talarico, and candidate in the U.S. Senate, said in a statement on Sunday that he is closely following reports of the shooting and that his prayers are with the community right now.

"Previous incidents have shown that this agency cannot be trusted to report all the facts. We need a full, independent investigation that includes the release of any and all available footage," Talarico said.

Democratic U.S. Rep. Lloyd Doggett, TX-37, who represents part of Austin, said in an interview with CNN on Sunday afternoon that he joins other officials in their call for an independent investigation into the shooting.

"Normally we might say 'well, give law enforcement the benefit of the doubt' but we can't do that with ICE because it has lied so often in the past," Doggett said. "It's engaged in wanton violence against protestors and against immigrants."

Austin community protests ICE shooting

AUSTIN, TEXAS - SEPTEMBER 20: People protest against Immigration and Customs Enforcement (ICE) officers on September 20, 2026 in Austin, Texas. A federal ICE officer shot and wounded a person earlier this afternoon in North Austin.

As the Texas Tribune reported, dozens of protesters gathered at the site of the shooting throughout the day, angrily shouting at law enforcement officers.

Photos from the site where the shooting happened document protesters gathering, shouting at law enforcement and holding the flag of Mexico and signs in Austin.

At one point, one photo shows law enforcement using tear gas on protesters Sunday night — but the reason why it was used was unknown.
